The Zhytomyr District Court found MP from Batkivshchyna Andrii Nikolaienko innocent in the case of a road accident in which an 18-year-old girl was killed on November 3, 2023.
The verdict in the case was published in the register of court decisions on April 27.
The text of the verdict does not mention the name of the accused, but the circumstances of the case indicate that it concerns MP Andrii Nikolaienko.
What is known about the road accident with Nikolaienko
The road accident occurred at around 10:00 am on the Kyiv-Chop highway near the village of Berezivka, Kyiv Region. The car driven by Nikolaienko hit an 18-year-old girl who was crossing the roadway. She died on the spot from her injuries.
After the accident, the MP stated that he was sober, did not violate traffic rules, and was ready to assist in the investigation.
What was the MP accused of
Nikolaienko was charged under Part 2 of Article 286 of the Criminal Code of Ukraine - violation of traffic rules, which caused the death of a person. The sanction of the article provides for three to eight years of imprisonment.
Why was MP Nikolaienko acquitted
The court found that the car was moving at a speed of 140–145 km/h. The decision states that if the driver had driven at the maximum permitted speed of 110 km/h and braked in time, the driver could have avoided the collision.
At the same time, the court concluded that the danger to traffic was created by the actions of a pedestrian who was crossing the road in a prohibited place. The decision states that a fence has been installed on the site, and there are overpasses and underground crossings nearby.
As Ukrainian News Agency earlier reported, on November 3, MP Andrii Nikolaienko hit and killed a girl on the Kyiv-Chop highway in the village of Berezivtsi, Zhytomyr district.
MP Andrii Nikolaienko himself confirmed that he had hit a person and stated that he had not violated traffic rules and was driving sober.
However, 40 minutes before the accident that resulted in the death of an 18-year-old girl, a car driven by Andrii Nikolaienko, a member of parliament from the Batkivshchyna faction, exceeded the speed limit, resulting in a fine of UAH 340.
