Girl whose photo was published by monobank co-founder Gorohovsky demands compensation and apology - lawyers

The ADDATI GROUP law firm announced on its Facebook page that it is launching legal protection for Karyna Kolb, whom monobank co-founder Oleg Gorohovsky accused of video verification against the background of the russian tricolor and whose photo he published on social networks. The lawyers noted that the businessman's act is a "gross violation of the girl's right to privacy, protection of personal data, and respect for honor and dignity."

Thus, the lawyers emphasized that the Constitution of Ukraine, international legal acts, and the laws of Ukraine guarantee everyone the right to banking secrecy, protection of personal data, inviolability of private life, and respect for honor and dignity.

"However, all these rights of our 19-year-old client were recently grossly violated by a public representative of one of the largest banking institutions in Ukraine. Over the past four days, Ms. Karyna has become the object of a massive wave of public harassment and unfounded accusations. As a result, not only she suffered, but also her family, in particular her father, who is an active serviceman of the Armed Forces of Ukraine," the report said.

The lawyers noted that this situation caused Karyna Kolb's health to deteriorate, and she was forced to seek medical help.

"Doctors recorded an acute reaction to prolonged stress, insomnia, in connection with which supportive medication was prescribed. As of now, she is at home and temporarily does not attend work," the lawyers said.

The lawyers added that they drew attention to Gorokhovsky's public statement, in which he partially admitted the wrongfulness of his actions. However, he did not apologize to Karyna Kolb.

According to lawyers, within the next three days, pre-trial demands will be sent to Oleg Gorokhovsky's JSC "Universal Bank" and other authorized persons of the relevant legal entity with a proposal to settle the dispute. The main conditions of such a settlement:

  • public personal apologies from Mr. Gorokhovsky on all his personal pages on which the relevant information was distributed, as well as its refutation;
  • compensation for the damage caused, including monetary compensation for moral and emotional suffering;
  • unblocking the client's bank account.

The ADDATI GROUP message also notes that a separate legal request will be sent to the banking institution regarding information that appeared in the national media about the possible existence of an internal chat room of bank employees, where photos and videos of clients obtained during the identification procedure (KYC) can be distributed.

"In the event of a refusal to settle the dispute out of court and the continuation of communication in the style that we have observed all these days, we reserve the right to apply to the court and other institutions provided for by law to protect the rights of our client," the lawyers emphasized.

As Ukrainian News Agency earlier reported, on March 9, monobank co-founder Oleg Gorohovsky published in Threads the story of client Karyna Kolb, who contacted the bank with a question about blocking her account, undergoing video verification allegedly against the background of the russian tricolor.

On March 10, serviceman Serhii Hnezdilov said that he had talked to the girl to understand the story of her blocking and the fact that Gorohovsky published her photo. According to him, Kolb said that she was at a video conference against the background of the Slovenian flag, which hung in her friend's room, and from where she connected to resolve the issue with blocking the card.

On March 11, Gorohovsky stated that he had "drawn conclusions" after the situation with the publication of the bank client Karyna Kolb's data, but did not apologize to the girl.

On March 12, the Verkhovna Rada Commissioner for Human Rights Dmytro Lubinets reported that proceedings had been opened and an investigation into the circumstances of a possible violation of the legislation on the protection of personal data and banking secrecy as a result of the publication of the client's personal data by the co-founder of monobank Gorohovsky had begun.

The National Bank also demands explanations from Gorohovsky as to why he published a photo of a monobank client.

Meanwhile, the president of the Kyiv School of Economics, Tymofii Mylovanov, stated that he would have done the same as Oleg Gorohovsky in his sharp reaction to the Slovenian flag, which he mistook for the russian one.
