Zelenskyy signs law on liquidation of MSEC

President Volodymyr Zelenskyy signed a law on the liquidation of medical and social expert commissions (MSEC).

This is evidenced by the website of the Verkhovna Rada, Ukrainian News Agency reports.

In particular, it is noted that the bill on amendments to certain legislative acts of Ukraine regarding the implementation of the assessment of daily functioning of a person (No. 12178), adopted by the Verkhovna Rada on December 19, was returned with the signature of the President of Ukraine on December 30.

The law provides that from January 1, 2025, instead of the MSEC, expert commissions will operate in cluster and supracluster hospitals, which will conduct an assessment in accordance with the criteria of the International Classification of Functioning, Life Limitations and Health.

The term "assessment of daily functioning of a person" is introduced instead of "medical and social expertise". To prevent corruption, the commissions will selectively receive a patient for consideration, but neither the patient nor the commission will know which doctor will consider the issue.

It is assumed that the new system will be digitalized, the attending physician will be able to electronically refer the case for assessment, and the assessment results will automatically be entered into the Unified Information System of the Social Sphere for further steps regarding rehabilitation, assessment of work capacity and, if necessary, the assignment of state payments.

A medical conclusion on temporary incapacity for work is formed for the entire period of the condition that leads to temporary loss of work capacity.

Mechanisms for appealing the decisions of the teams are also provided.

The new assessment system will be financed through the National Health Service of Ukraine (NHSU).

The previously established statuses of persons with disabilities, as well as medical and social expertise for children, will remain unchanged.

As Ukrainian News Agency earlier reported, on December 19, the Verkhovna Rada adopted in the second reading a bill proposing to eliminate medical and social expert commissions (MSEC).

On October 22, President Volodymyr Zelenskyy instructed the Cabinet of Ministers to develop and submit to the Verkhovna Rada a bill for the urgent reform of the system of medical and social expertise in Ukraine, providing, in particular, for the liquidation of medical and social expert commissions (MSEC) from December 31, 2024.

On October 22, Zelenskyy held a meeting of the National Security and Defense Council due to abuses occurring in the MSEC and information about the mass recruitment of disability groups by prosecutors.
