The National Agency on Corruption Prevention (NACP) accuses Prime Minister Denys Shmyhal of disclosing information about a corruption whistleblower.
This is stated in the message of the NACP, Ukrainian News Agency reports.
"The head of the National Agency on Corruption Prevention (NACP), Oleksandr Novikov, drew up a protocol regarding the Prime Minister of Ukraine, Denys Shmyhal. He illegally disclosed information about the whistleblower, which became known to him in connection with the performance of his official duties," it says.
The NACP declares that the head of the government, having previously considered the report on corruption from the whistleblower, namely the employee of the Commission for Regulation of Gambling and Lotteries (CRGL), instructed the relevant officials to process such a report and, based on the results, inform the applicant and the Cabinet of Ministers.
At the same time, the head of the CRGL, Ivan Rudyi, whose illegal actions were reported, is among the officials who were instructed to consider the report.
After learning about this, the official decided to initiate disciplinary proceedings against the whistleblower.
The NACP emphasizes that, according to the legislation, the whistleblower cannot be brought to disciplinary responsibility or subjected to other negative measures of influence by his manager or employer.
Having established the fact of such actions, the NACP drew up a report on the head of the CRGL on January 5.
Thus, according to the NACP, Shmyhal committed an administrative offense provided for by the Code of Administrative Offenses (Part 2 of Article 1728 entails the imposition of a fine from 1,000 to 2,500 tax-free minimum incomes of citizens (UAH 17,000-42,500) with deprivation of the right to hold certain positions or engage in certain activities for a period of one year), because he illegally disclosed information about the whistleblower, which became known to him in connection with the performance of official duties.
The NACP invited Shmyhal to review the protocol for January 10, but he did not appear on the specified date and did not report the reasons for his absence.
Therefore, the NACP sent the protocol for consideration to the court at the place of the offense.
If the court finds Shmyhal guilty of committing an administrative offense, the official will be fined and deprived of the right to hold certain positions for one year, which will be the basis for entering information about him into the Unified State Register of Persons Who Committed Corruption or Corruption-related Offenses.
As Ukrainian News Agency reported, earlier, the NACP accused Shmyhal of not submitting resolutions for anti-corruption examination and demanded an official investigation.
In December, the NACP drew up an administrative protocol on corruption against the head of the Commission for Regulation of Gambling and Lotteries Ivan Rudyi.
