Ukrposhta pays fine to NBU and will appeal it in court

JSC Ukrposhta paid the fine to the National Bank of Ukraine (NBU) and will appeal it in court.

This is stated in the message of the postal operator, Ukrainian News Agency reports.

"The specified fine has already been paid in full. Despite this, JSC Ukrposhta categorically disagrees with the grounds for its application and will appeal the relevant decision of the regulator in court," the message says.

It is noted that the regulator imposed a fine for failure to comply with an obviously illegal requirement, since it provided for the provision of information and documents that do not relate to the scope of the NBU's activities and fall within the competence of the shareholder of JSC Ukrposhta - the Ministry of Development of Communities and Territories of Ukraine. In particular, we are talking about conference discussions on the format and ways of providing postal services during a full-scale invasion.

It is reported that in fact this is an attempt to establish control over the independent supervisory board of Ukrposhta. The NBU's position ignores the fact that Ukrposhta is primarily a national postal operator, and that money transfer activities under the NBU's license are an additional, not the company's main activity.

JSC Ukrposhta regards such requirements of the National Bank as interference in the independent activities of corporate governance bodies, in particular supervisory boards, and as an attempt to replace corporate governance with regulatory pressure.

The company views this situation not as a technical dispute over documents, but as a fundamental attempt to interfere with the independence of corporate governance in Ukraine. JSC Ukrposhta will defend this position in court.

As Ukrainian News Agency earlier reported, at the end of last year, the National Bank applied a measure of influence in the form of a written warning to the joint-stock company Ukrposhta (EDRPOU 21560045) for violating the requirements of the legislation of Ukraine regulating activities in the payment market.
