AMCU fines 2 companies UAH 19 million for collusion in procurement of technical salt

On November 13, 2025, the Antimonopoly Committee of Ukraine made a decision recognizing the actions of SOLT INDUSTRY LLC and KIP & CO Trading House LLC as violations of the legislation on the protection of economic competition in the form of committing anticompetitive concerted actions related to the distortion of the results of six tenders for the purchase of technical salt.

This is stated in the report of the AMCU, the Ukrainian News agency reports.

The bidding was conducted by the Municipal Enterprise "Road Maintenance Department for the Repair and Maintenance of Highways and Facilities on them of the Dniprovskyi District" of Kyiv. Kyiv, ME "SECTION FOR REPAIR, MAINTENANCE OF ROADS AND FACILITIES ON THEM" (2 bidding procedures), KPTM "Kryvorizheplomerezha", ME "Polihon Ekolohiia" and ME "KYIVTEPLOENERGO" from May 2024 to March 2025, with a total expected value of UAH 33,575,500.

During the investigation of the case, the Committee established the circumstances and facts that, in their entirety, indicate joint and coordinated behavior of the companies and, as a result, the commission of a violation and the elimination of competition between them during participation in the said tenders.

The AMCU recognized such actions of SOLT INDUSTRY LLC and KIP & CO Trading House LLC as a violation under paragraph 4 of part two of Article 6, paragraph 1 of Article 50 of the Law of Ukraine "On Protection of Economic Competition" in the form of committing anticompetitive concerted actions related to the distortion of bidding results and fined them UAH 18,911,880.

As the Ukrainian News agency earlier reported, according to the Law of Ukraine "On Public Procurement", the grounds for refusal to participate in the procurement procedure is the fact that a business entity (participant) has been brought to responsibility for committing anticompetitive concerted actions related to the distortion of tender results over the past three years.
