The European Business Association expressed concern on behalf of business representatives over possible duplication of requirements with the REACH technical regulation, which already provides for the submission of information on the hazardous properties of chemical substances to the Ministry of Environment.
This is stated in the EBA message, the Ukrainian News agency reports.
The association recalls that the electronic system of the State Register of Hazardous Factors begins to operate from July 1 and emphasizes that the simultaneous implementation of the provisions of the new Procedure for the State Registration of Hazardous Factors and the already existing technical regulations may lead to double submission of documents, and as a result, an additional administrative burden on business and state authorities, in particular - on the registry administrator - the Ministry of Health of Ukraine (MOH).
The association emphasizes that other technical regulations are also in force, which already cover the circulation of chemical products and electronic equipment, which are the product of the implementation of the norms of the European REACH regulation.
According to business representatives, the European Union does not provide for a separate procedure for registering hazardous factors and a similar package of documents required by the Procedure for submitting to the Ministry of Health in addition to REACH.
The business has addressed the Ministry of Health with a corresponding appeal and hopes that the position of the business community will be taken into account in the further implementation of the provisions of the Procedure for state registration of hazardous factors.
As the Ukrainian News agency earlier reported, the E-register of hazardous chemical and biological substances at the Ministry of Health will start operating in Ukraine from July 1.
On July 23, 2024, the Cabinet of Ministers approved the Technical Regulation on the Safety of Chemical Products, which implemented the norms of the European REACH regulation. Its mandatory requirement is the registration of all chemical substances produced and imported in Ukraine in volumes exceeding 1 ton per year.
The State Environmental Inspectorate carries out market surveillance, and the Ministry of Ecology implements the regulation.
REACH places responsibility on industry to manage the risks associated with chemicals and to provide information on the safety of substances. To this end, manufacturers and importers are required to collect information on the properties of their chemicals and register this information in a central database of the European Chemicals Agency (ECA).
