High Anti-Corruption Court again orders Kobolev to hand over his foreign passport

The High Anti-Corruption Court (HACC) again ordered the former chairman of the board of Naftogaz of Ukraine Andrii Kobolev to hand over his foreign passport and imposed other obligations on him.

This was announced by the Specialized Anti-Corruption Prosecutor's Office (SAPO), Ukrainian News Agency reports.

On December 3, the panel of judges of the High Anti-Corruption Court granted the request of the prosecutor of the SAPO and imposed procedural obligations on the former chairman of the board of Naftogaz of Ukraine.

According to the court's decision, the accused is obliged to:

– notify the court of a change in his place of residence;

– refrain from communicating with witnesses in the case;

– hand over all passports for travel abroad to the State Migration Service of Ukraine.

We remind you that on November 1, 2024, the SAPO prosecutor applied to the court with a motion to extend the term of the procedural obligations imposed on the accused in connection with the application of a preventive measure in the form of bail in the amount of UAH 107,127,000.

However, the subsequent court hearings at which the court was to consider the said motion, namely on November 5, 2024 and November 8, 2024, were not held at the court's initiative, in connection with which the term of the procedural obligations expired on November 12, 2024.

On November 8, 2024 and November 11, 2024, the Specialized Anti-Corruption Prosecutor's Office sent letters to the HACC on November 8, 2024 and November 11, 2024 with a request to consider the motion to extend the preventive measure until its expiration. However, an additional hearing was never scheduled.

According to the investigation, during 2018, the chairman of the board of Naftogaz of Ukraine was illegally accrued and paid bonuses in an amount exceeding the maximum allowable by UAH 229,250,410.

During 2018-2021, officials of Naftogaz of Ukraine did not facilitate the investigation, hiding from the investigation the company's documents and materials necessary to establish the circumstances of the crime.

The actions of the former chairman of the board are qualified under Part 5 of Article 191 of the Criminal Code of Ukraine. The sanction of the article provides for a penalty in the form of imprisonment for a term of 7 to 12 years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to 3 years and confiscation of property.

As Ukrainian News Agency earlier reported, Koboliev's ban on traveling abroad was lifted and other duties were canceled.
