The hospital guard, who did not open the door of the shelter in Kyiv, was sentenced to 4 years in prison.
This was announced by the press service of the Kyiv City Prosecutor's Office, Ukrainian News Agency reports.
"The Desnianskyi district court found the hospital security guard guilty of knowingly leaving without help persons who were in a life-threatening condition and deprived of the opportunity to take measures for self-preservation due to the helpless state, if there was an opportunity to provide them with help, which led to the death of three people (Part 3 Article 135 of the Criminal Code of Ukraine) the court sentenced the accused to 4 years of imprisonment,” the statement reads.
The prosecutor proved in court that the security guard of the communal non-profit enterprise "Center for primary medical and sanitary care No. 3" during the announcement of the "air alert" signal in Kyiv on the night of June 1, 2023, did not open the shelter door, thereby depriving people of the opportunity to save their lives.
His actions during the missile attack on Kyiv by the russian armed forces caused the death of three people, including a 9-year-old girl.
The death of a minor child in accordance with Article 67 of the Criminal Code of Ukraine is an aggravating circumstance. Sanction of Part 3 of Article 135 of the Criminal Code of Ukraine provides for punishment in the form of imprisonment for a term from 3 to 8 years.
It is noted that the accused did not admit his guilt, did not repent of the committed criminal offense, during the trial he constantly changed his testimony regarding the circumstances of the event and the reasons why he did not open the shelter door (he did not have time, did not hear the air alert signal, did not see people). In the end, the accused told the court that the hospital premises were not equipped with a shelter at all and he was not obliged to open the door to it.
The prosecutor's position in the court debate is to sentence the accused to imprisonment for a term of 6 years and 6 months.
Currently, prosecutors are studying the court's verdict regarding the grounds for its appeal.
As Ukrainian News Agency earlier reported, on the night of June 1, 2023, the russian occupiers launched a missile attack on Kyiv, launching 10 Iskander ballistic and cruise missiles.
Air defense forces shot down all the missiles, but two women and a child were killed as a result of falling debris. It later became known that they were killed because they could not get into the bomb shelter at the polyclinic during the air alert because the doors were closed.
Due to the closed shelter in Kyiv, four people were detained - the first deputy of the Desnianskyi District State Administration of Kyiv Iryna Alieksieienko, the director of the polyclinic with a closed shelter, his deputy, as well as a guard.
