Allow Killing Military For Failure To Comply With Order Or Desertion - Servant Of The People Bill

Members of the Verkhovna Rada from the Servant of the People faction Heorhii Mazurashu and Oleksandr Fedienko propose that parliament allow commanders to kill their subordinates if they arbitrarily leave their places of deployment or do not comply with the order in a combat situation.

This is stated in Bill No. 7351, Ukrainian News Agency reports.

According to the current legislation, in a combat situation, a commander (chief) can use weapons or give subordinates an order to use them if in another way it is impossible to stop a criminal offense, without causing death to a serviceman.

The bill proposes to exclude from this article the line "without causing death to a serviceman."

Criminal offenses used in this norm mean disobedience, resistance or threat to the commander, the use of violence, desertion.

"The bill defines a legislative basis for realizing the possibilities to terminate a criminal offense that falls under the signs of a criminal offense related to disobedience, resistance or threat to the boss, the use of violence, unauthorized abandonment of combat positions and certain places of deployment of military units (divisions) in martial law or combat situation, in order to detain such a serviceman," the explanatory note says.

As Ukrainian News Agency earlier reported, 14 members of the Rada propose to parliament to prohibit the courts from suspending the order or order of the commander (chief) given to the serviceman in martial law or in a combat situation.
