Court Reinstates Sivers As Director Of Anticorruption Legislation Department At Justice Ministry

The District Administrative Court of Kyiv has reinstated Robert Sivers in his capacity of director of the anticorruption legislation department at the Ministry of Justice.

The Ukrainian News Agency learnt this from the court's materials.

Sivers was appointed the department's director in May 2015.

Later the Prosecutor General's Office (PGO) initiated an internal check into the improper and incomplete keeping of the State Register of Officials with the History of Corruption.

Following the results of the internal investigation, Sivers was fired on April 28, 2016 for breaking the oath of the state official.

Sivers challenged the decision in court, demanding to reinstate him in the position.

In its ruling made in his favor, the court, citing the legislation in force, stated that legally there was no such a form of control as an internal check.

The court also took into consideration that the results of the internal check provided by the PGO in its submission to the court did not contain plain evidence of the perjury by Sivers.

The court thus repealed a decision of the Ministry of Justice about firing Sivers and ordered reinstating them in his position from April 29, 2016.

In addition, the court also charged the ministry with UAH 323,700 of the average wages of Sivers not paid to him during all this time.

As Ukrainian News Agency earlier reported, in 2016, Sivers applied for the position of a member of the National Agency on Corruption Prevention.
