Gazprom Challenges Antimonopoly Committee's Fine Of UAH 172 Billion At Supreme Court Of Ukraine

Gazprom has challenged at the Supreme Court of Ukraine the ruling of the Higher Economic Court which has rejected an appeal of Russia's gas monopoly against the decision of the Antimonopoly Committee of Ukraine that envisions fining the Russian company UAH 172 billion for monopoly abuse in the natural gas transit market of Ukraine.

This is said in the ruling of the Supreme Court of August 15, Ukrainian News Agency reports.

The State Enforcement Service of Ukraine has collected UAH 79.877 million of dividends the Kyiv-based private joint stock company Gaztransit, in which Gazprom owns 40.2% of shares, intended to pay to Gazprom, as Gazprom is obliged to pay a fine of UAH 172 billion that the Antimonopoly Committee of Ukraine imposed on Russia's gas monopoly.

The State Enforcement Service has arrested 40.2% of the shares of Gaztransit owned by Gazprom.

An appeal court overturned a decision of the Economic Court of Kyiv of June 6, which allowed the State Enforcement Service collecting UAH 79.877 million of dividends of Gaztransit.

The litigation continues.

As Ukrainian News Agency earlier reported, the Antimonopoly Committee fined Gazprom UAH 85.966 billion on January 22, 2016, for abusing its monopoly on the market of transit of natural gas through Ukraine during the period of 2009-2015.

Gazprom tried to appeal against the ruling of the Economic Court of Kyiv on dismissal of its motion without consideration, but the courts of higher instance upheld the ruling.

The Antimonopoly Committee filed a lawsuit with the Kyiv Economic Court on October 5, 2016, asking the court to forcibly recover the fines and penalties totaling UAH 172 billion.

In December 2016, the Antimonopoly Committee won the litigation and the ruling has been upheld by appeal courts.
