Law Strengthening Measures Against Cruel Treatment Of Animals Takes Effect

The law strengthening measures against cruel treatment of animals has taken effect.

The Law was published by the Holos Ukrainy parliamentary newspaper on August 3 and took effect the next day after being published, Ukrainian News Agency reports.

The relevant amendments have been made to the Penal Code.

According to the document, abuse of animals committed with cruel methods or with hooligan motives is punishable by arrest for up to six months or restriction of freedom for up to three years.

The same actions committed in the presence of a minor are punishable by restriction of freedom for a period of three to five years or imprisonment for the same period.

These same actions are punishable by imprisonment for five to eight years if they are committed with special cruelty, if they lead to injury or death, or if they are committed by a group of people.

In addition, the document increases the liability for cruelty to animals and providing for a fine of 200-500 non-taxable minimum incomes of citizens (UAH 3,400-8,500) in the Code of Administrative Offenses.

As Ukrainian News Agency earlier reported, President Petro Poroshenko signed this law on August 1, but with certain comments.

Poroshenko noted the necessity for specification of elements of crime envisioned by Sections 2 and 3 of new wording of Article 299 of the Penal Code of Ukraine as the said two sections for one and the same crime - animal abuse in presence of minors - envision different types of punishment.

Besides, the wording of Section 3 requires agreement with Article 67 of the same Code.
