Supreme Court upholds NBU's right to foreclose on property complex in Kyiv to repay Finance and Credit bank's debt

The Commercial Cassation Court within the Supreme Court upheld the National Bank’s right to forcibly sell the assets of Osnova Construction Company LLC to partially repay the refinancing loan debt owed by JSC Bank "Finance and Credit" to the National Bank.

This is stated in a press release from the NBU, the Ukrainian News agency reports.

The property in question is a complex with a total area of 22,621 square meters, located at 4/6 Ioanna Pavla II Street, Kyiv.

On May 26, 2026, the Supreme Court issued a ruling to close the cassation proceedings regarding the cassation appeal filed by Osnova Construction Company LLC. At the same time, the decisions of the lower courts, which fully upheld the National Bank’s claim for foreclosure on the property complex, were upheld.

In 2008, Osnova Construction Company LLC entered into a mortgage agreement with the National Bank for the property complex to secure the performance of obligations under refinancing loans provided by JSC Bank “Finance and Credit.”

Since JSC Bank "Finance and Credit" failed to fulfill its obligations under the loans, the National Bank filed a lawsuit seeking foreclosure on the real estate property based on the court’s decision.

By a decision of the Commercial Court of Kyiv dated July 9, 2025, the National Bank’s claim was granted in full. By a ruling of the Northern Commercial Court of Appeal dated February 17, 2026, the aforementioned court decision was upheld.

After the decision of the Kyiv Commercial Court became final, the National Bank obtained orders for the enforcement of the court decision and initiated enforcement proceedings, including those regarding the foreclosure on the property complex.

As the Ukrainian News agency earlier reported, on September 17, 2015, the National Bank decided to classify JSC Bank "Finance and Credit" as insolvent.

The total outstanding debt of JSC Bank "Finance and Credit" to the National Bank on refinancing loans amounts to UAH 5.5 billion.
