Government plans to change booking rules - MP Zhelezniak announces innovations

The Cabinet of Ministers of Ukraine is preparing to update the procedure for booking employees liable for military service.

The draft resolution, which is being considered today at a government meeting, provides for significant changes to the criteria for determining the criticality of enterprises, salary requirements, and control over the number of booked personnel.

MP Yaroslav Zhelezniak has announced this.

Zhelezniak explained that the new rules are intended to make the booking system more rigorous and transparent, as well as reduce opportunities for formally or “artificially” obtaining the status of a critical enterprise.

To book an employee, the minimum salary threshold is being raised: it must now be at least three times the minimum wage (previously 2.5 times). The criteria for determining critical enterprises are being adjusted similarly. Exceptions remain for state-owned and municipal enterprises, as well as certain categories.

For enterprises operating in combat zones, potential combat zones, or temporarily occupied territories, the old 2.5 multiplier remains in effect. In other words, the threshold is not being raised for them.

Enterprise managers will be required to submit an application through the "Diia" portal within 10 business days to cancel excess bookings if the established limits are exceeded.

Exceeding the permitted number of booked positions may serve as grounds for revoking the status of a critically important enterprise.

Employees with deferrals for other reasons, as well as those holding multiple jobs, will be counted only at one place of employment.

It is not enough to be a resident—companies must meet additional requirements of the Digital Economy Act, which will be confirmed by tax reports for the past 6 months.

Information on the specific criteria used to grant the status will be added to the Unified List of Critical Enterprises.

Government agencies must review sectoral and regional criteria to ensure they apply only to truly critical enterprises.

The MP stated that the new rules are expected in the near future, as follows:

- by June 10, 2026 — review of sectoral and regional criteria;

- by July 1, 2026 — verification of enterprises’ compliance with the new requirements;

- by September 1, 2026 — review of previous decisions regarding criticality;

- starting September 1, 2026 — the increased coefficient of 3.0 and certain other regulations will take effect.
