Ihor Kolomoiskyi's lawyers have sent an appeal to the Court of Appeal against the decision of the High Court of London in the case of the claim of JSC CB PrivatBank for recovery of damages in case No. BL-2017-000665. This was reported by Ihor Kolomoiskyi's representative, lawyer Oleksandr Lysak, UNIAN reports.
"The Court of Appeal will review all the conclusions set out in the decision of the court of first instance. Until the end of the appeal hearing, the decision of the High Court of London cannot be considered final, since there is a possibility that it will be overturned on appeal. In such a case, all actions aimed at implementing the decision of the court of first instance will be subject to immediate reversal with compensation for all related costs," Lysak explained.
The lawyer noted that the preliminary refusal of the court of first instance to grant leave to appeal in no way limits the party's right to appeal the decision directly to the court of appeal:
"Moreover, the said refusal to grant leave to appeal will also be reviewed by the court of appeal for legality together with the main decision in the case."
The lawyer added that Ihor Kolomoiskyi's party hopes for an effective, full and comprehensive review by an independent court of appeal of all the reasons and conclusions set out in the decision of the court of first instance.
