On October 30, 2025, the Antimonopoly Committee of Ukraine adopted four decisions recognizing the actions of TB FRUIT CAPITAL LLC as a violation of the Law of Ukraine "On the Protection of Economic Competition".
This is indicated in the AMCU's statement, the Ukrainian News agency reports.
In July 2021, the company, which is a juice producer, acquired 100% shares in the authorized capitals of ARSENAL INVESTGROUP KHMELNYTSK LLC, ARSENAL INVESTGROUP VINNYTSIA LLC, ARSENAL INVESTGROUP LLC, and ARSENAL INVESTGROUP HORODOK LLC without obtaining the relevant permission from the Antimonopoly Committee of Ukraine, the presence of which is required.
The Antimonopoly Committee of Ukraine has initiated cases of violations regarding the implementation of the specified concentrations by the company without the prior permission of the Committee.
A concentration that requires permission in accordance with Part One of Article 24 of the Law of Ukraine "On the Protection of Economic Competition" is prohibited until a permit is granted for its implementation.
Until such a permit is granted, the participants in the concentration are obliged to refrain from actions that may lead to restriction of competition and the impossibility of restoring its initial state.
Thus, TB FRUIT CAPITAL LLC made the specified acquisitions without prior receipt of the Committee's decisions on granting permits for the acquisition of 100% shares in the authorized capitals of the above-mentioned companies.
The AMCU recognized such actions of the company as violations in the form of implementation of concentrations without obtaining the relevant permits from the bodies of the Antimonopoly Committee of Ukraine, the presence of which is required, and based on the results of consideration of 4 cases, fined it for a total amount of UAH 39,103,231.
As the Ukrainian News agency earlier reported, the Temporary Administrative Boards of the Antimonopoly Committee of Ukraine, at their meetings on October 22, recognized the actions of two water utilities as violations provided for in Clause 1 of Part 2 of Article 13 and Clause 2 of Article 50 of the Law of Ukraine "On the Protection of Economic Competition", imposed fines on the enterprises in the total amount of over UAH 11 million and obliged them to stop the violations.
