NBU updates procedure for conducting on-site and non-on-site monitoring of payment infrastructure oversight facilities

The National Bank of Ukraine (NBU) updated the procedure for conducting on-site and non-on-site monitoring of payment infrastructure oversight facilities.

This is stated in the NBU message, Ukrainian News Agency reports.

The purpose of the update was to bring the procedure into line with the current requirements of the legislation, namely:

- the Law "On Amendments to Certain Legislative Acts of Ukraine on Improving the Functions of the National Bank of Ukraine in State Regulation of Financial Services Markets";

- the Regulation on the Presentation of Requirements and Application of Influence Measures by the National Bank of Ukraine to Payment Infrastructure Oversight Facilities, approved by the Resolution of the Board of the National Bank of Ukraine dated May 9, 2023 No. 61 (as amended), updated in January 2025.

In particular, in this regard, the National Bank:

- clarified the list of oversight objects, excluding payment service providers and electronic money issuers operating outside payment systems, since they have come under the exclusive competence of supervision;

- clarified the system of indicators for on-site monitoring of oversight objects and the procedure for conducting on-site monitoring of systemically important payment systems, important payment systems and important technological operators;

- clarified the term "significant deviations in the performance indicators of an oversight object" when submitting statistical reporting by oversight objects to the National Bank;

- introduced the possibility of the National Bank preparing administrative proceedings on the application of measures of influence against an oversight object in the event that violations of the legislation of Ukraine are detected by it based on the results of on-site / on-site monitoring;

- determined the date of commencement of administrative proceedings in an administrative case on the application of a measure of influence to the object of oversight based on the results of the monitoring conducted on it (from the date of drawing up by the National Bank of a certificate on identified violations of the legislation of Ukraine based on the results of non-visit monitoring / certificate on on-site monitoring of the object of oversight / act on creating obstacles to on-site monitoring) and the procedure for sending the above-mentioned documents to the object of oversight;

- unified the requirements and deadlines for the execution of documents based on the results of on-site monitoring and their exchange with the object of oversight.

As Ukrainian News Agency earlier reported, payment infrastructure oversight is the activity of the National Bank to ensure the continuous, reliable and effective functioning of the payment infrastructure.
