High Anti-Corruption Court refuses to remove head of Antimonopoly Committee from office

The Hight Anti-Corruption Court (HACC) has considered the petition regarding the head of the Antimonopoly Committee of Ukraine (AMCU) Pavlo Kyrylenko and refused to remove him.

The High Anti-Corruption Court announced this, Ukrainian News Agency reports.

On August 11, the High Anti-Corruption Court partially satisfied the prosecutor's petition and imposed a number of obligations on the accused, namely:

- to appear at every request to the prosecutor and the court;

- not to leave the borders of Ukraine without the permission of the court;

- to notify the court of a change of his place of residence;

- to refrain from communicating personally and through other persons with witnesses specified in the court's ruling;

- to deposit with the State Migration Service of Ukraine his passport(s) for travel abroad, other documents giving the right to leave Ukraine and enter Ukraine, except for the passport of a citizen of Ukraine.

At the same time, the panel of judges of the High Anti-Corruption Court refused to grant the motion of the SAPO prosecutor to remove the accused from office. We will remind, the Chairman of the Antimonopoly Committee is accused of committing criminal offenses stipulated by Part 2 of Article 366-2, Article 368-5 of the Criminal Code of Ukraine.

According to Part 1 of Article 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in accordance with the law and established by a court verdict of conviction.

As Ukrainian News Agency earlier reported, the court chose a preventive measure in the form of a bail of UAH 9 million for the wife of the Chairman of the Antimonopoly Committee Pavlo Kyrylenko, Alla Kyrylenko. The Head of the Antimonopoly Committee Kyrylenko was served with a new suspicion of failure to declare property. His wife also received suspicion. The electronic bracelet was removed from the Chairman of the Antimonopoly Committee Kyrylenko. NABU and SAPO have completed the investigation into the illegal enrichment of the Chairman of the AMCU Kyrylenko by UAH 70 million. A bail of UAH 30 million was paid for the Chairman of the AMCU Pavlo Kyrylenko, who is suspected of illegal enrichment, in accordance with the court decision. Earlier, the court refused to arrest the Chairman of the AMCU Kyrylenko and released him on bail of UAH 30 million. According to the National Anti-Corruption Bureau and the Specialized Anti-Corruption Prosecutor's Office, in 2020–2023, the suspect, while holding the position of head of the regional state administration, acquired 21 real estate properties and a luxury car, registering the property in the names of his wife's relatives.
