The European Court of Justice has recognized sanctions against the former CEO of Motor Sich Vyacheslav Bohuslaev as unlawful. The sanctions themselves in the EU still exist, but news on this issue is expected in the near future.
This was stated by Bohuslaev's lawyer, the head of Kravets and Partners Bar Association, Rostyslav Kravets.
The lawyer explained that sanctions in Ukraine were introduced in connection with the fact that Ukraine appealed to the Council of Europe, and after that they were introduced in Europe, after that, solely on the basis that sanctions were introduced in Europe, they were introduced in Ukraine.
"No evidence of his guilt or illegal activities has been found so far. The unconstitutional High Anti-Corruption Court made its decisions on the Ministry of Justice's lawsuit for confiscation in connection with the imposed sanctions solely on the basis of selective covert investigative actions, while the defense side was not given permission to provide other covert investigative actions, the legality of which is in question at all.
Recently, it turned out that the engines that were rumored to have been supplied to the russian federation are all in China. That is, all the evidence is selective covert investigative actions and rumors. In addition, the confiscation provision itself in the Law on Sanctions appeared much later than the actions incriminated against the general designer," Kravets noted.
He added that as a result of the cancellation of the initial decision, the sanctions themselves in the EU still continue to exist: "Now they are being extended, and this extension of the sanctions canceled today is being appealed in the same way. Therefore, we expect another positive decision in the near future on the final cancellation of the sanctions."
In addition, as noted by the lawyer of Bohuslaev V.O. on June 11, 2025, in the Solomyanskyi District Court of Kyiv, despite the promises of the prosecution, not a single witness appeared at the court hearing in the case, and the prosecutor was unable to explain the reasons for this. The judicial panel reacted to the situation, emphasizing the ineffective work of the prosecutors and warned of the possibility of contacting the leadership of the Prosecutor General's Office in case of further delays.
Experts of the IAC ISHR monitoring mission established the delay of the process, the lack of proper preparation of the prosecution and ignoring the vulnerable state of the suspect, who has a disability and has been in custody for more than 3.5 years. Such actions create risks of violating Articles 3 and 6 of the European Convention on Human Rights.
In addition, this gives rise to reasonable suspicions of abuse of the detention mechanism as a means of psychological or physical pressure.
