NABU grossly and unprecedentedly violates laws - Bar Association filed a petition to the Prosecutor General

The National Bar Association of Ukraine has filed an application with the Prosecutor-General's Office and the State Bureau of Investigation over unprecedented violations by the NABU - illegal search and installation of a "wiretap" in the lawyers' office in Kiev.

"Detectives not only wiretapped, penetrated into the office of lawyers in the center of the capital, but also conducted there illegal searches "before the order of acceptance by the investigating judge without proper grounds", than grossly violated the rights and legitimate interests of lawyers", - writes UNN.

The Association notes that the search took place without a court ruling and the basic order of the prosecutor. At the same time, the NABU detectives knew that they were entering the office of lawyers, because this address is official and registered in the register of lawyers.

At the same time, no documents or things were seized as a result of the search.

According to the association, the decision on the illegal search was made by NABU detective Fedir Oliynyk, while the "wiretapping" was carried out by detective Yaroslav Voronizhskiy. The latter participated in the illegal search, but was not officially recorded as its participant. At the same time, he freely took out of the room a bag and a briefcase, which probably contained technical means for "wiretapping".

And the motion to conduct an ex post facto search was granted by the VAKS judge.

The Association considers such actions on the part of NABU as "criminal intent". In its opinion, the detectives wanted to obtain confidential information, which clients told to lawyers, and to find out further actions of the defense.

The equipment for "wiretapping" was found by the lawyers themselves in the floor of the premises in separate offices and directly in the room for negotiations, where the communication with clients took place. Thus, the NABU detectives violated the right to confidential exchange of information between the lawyer and the client.

The Association emphasizes that the group of NABU detectives includes those who investigate cases against the clients of these lawyers.

The Association calls on the Prosecutor General to intervene in the situation and initiate criminal proceedings against NABU officials who committed crimes under Articles 162, 365 and 397 of the Criminal Code of Ukraine (illegal entry into the possession of another person and illegal search therein committed by an official; abuse of power or official authority; commission of any form of obstruction of lawful activity by an official using his official position).
