Court overturns NACB detective’s decision to close case against Sytnyk and Novikov due to secondment of AFU soldier Shabunin to NACP

The High Anti-Corruption Court has overturned the decision of the National Anti-Corruption Bureau (NACB) detective to close the case against former deputy head of the NACP Artem Sytnyk and former head of the NACP Oleksandr Novikov due to the secondment of the Armed Forces of Ukraine (AFU) soldier Vitalii Shabunin from the army to the National Agency on Corruption Prevention (NACP).

This is evidenced by the court's ruling, the Ukrainian News agency reports.

On January 10, the High Anti-Corruption Court upheld the complaint of a lawyer in the interests of one of the AFU servicemen, who requested to cancel the decision to close the relevant case.

The case was opened in August 2024, but at the end of November it was closed by the decision of the NACB detective.

According to the circumstances of the case, the head of the NACP Novikov and the deputy head of the NACP Sytnyk sent letters to the military unit with a request to send soldier Shabunin to the NACP, in order to help him evade military service.

At the same time, in the absence of legal grounds, the commander of the military unit during 2022 - 2023 systematically sent soldier Shabunin, who was called up for mobilization, on business trips to the NACP and other organizations and institutions and paid him an additional remuneration in the amount of UAH 30,000 per month.

3a such circumstances, according to the complainant, an organized group, which included the commander of the military unit, the head of the NACP and the deputy head, committed a criminal offense, liability for which is established by Part 4 of Article 191 of the Criminal Code of Ukraine.

Instead, the NACB investigated these episodes under Article 364 (abuse of power or official position) of the Criminal Code.

As the Ukrainian News agency earlier reported, former MP and military servicewoman Nadia Savchenko called public figure Serhii Sternenko, journalist Yurii Butusov, and head of the Anti-Corruption Center Vitalii Shabunin "professional evaders."

The NACB opened a case regarding his "business trips" to the NACP and receipt of "combat" payments. And the State Bureau of Investigation is investigating a number of criminal cases against Shabunin, in particular, regarding mobilization evasion, forgery of the NACP documents, illegal use of humanitarian aid, and appropriation of a Nissan Pathfinder jeep that volunteers transferred to the Armed Forces of Ukraine.
