NABU-SAPO-HACC triangle may be liquidated due to inefficiency- legal community indignant amid scandals surrounding Anti-Corruption Court

The High Anti-Corruption Court (HACC) is degrading to the level of a "Soviet district court" due to its dependence on the National Anti-Corruption Bureau (NABU)- Specialized Anti-Corruption Prosecutors Office (SACPO) .

This is confirmed by a number of recent scandals and a "catastrophic" failure in IQ testing, which shocked even the public defenders of the HACC.

Political expert Oleh Posternak wrote about this in his blog.

According to him, in the last months of the year, the number of scandals compromising the entire composition of the High Anti-Corruption Court has increased sharply.

"Among the main topics are the "leak" of high-profile cases involving corrupt officials, who then flee abroad; the luxurious lifestyle of the HACC judges in the midst of the war; the execution by this court of the tasks of the NABU and the SAPO, which increasingly resembles the practice of the Soviet Themis. The apogee of these processes is the decline in the general intellectual level of the HACC and candidates for positions: the recent failure of the judicial corps in IQ tests shocked even public defenders of the anti-corruption court," the expert wrote.

He recalled the words of lawyer Taras Baranov about the HACC's adherence to a post-totalitarian approach - playing along with NABU detectives and SAPO prosecutors. And lawyer Rostyslav Kravets stated that the HACC's actions directly repeat the 37s of the last century: then individuals did not know what they were being accused of and on what grounds.

Among other scandals with the High Anti-Corruption Court, which Posternak cites, is the "extortion" of half a million hryvnias from the state by the High Anti-Corruption Court judge Kateryna Sikora with the help of colleagues in another court. Another judge of the High Anti-Corruption Court, Valeriya Chorna, became the owner of an elite car with a saloon - a BMW X6. in the midst of the war, judge Mykola Hlotov, who burst into tears, when he was disqualified in the court session, nevertheless bought a Tesla for almost UAH 2 million in a year after the start of the full-scale invasion. Judge Markiyan Halabala illegally received official housing and did not indicate a number of other details in his declaration. Vitalii Kryklyvyi, for whom his wife wrote court decisions, was also noticed in the housing fraud.

In addition, the expert cited data that, according to the results of testing to identify the level of cognitive abilities (IQ test), out of 74 candidates for the positions of judges of the HACC, only 25 candidates scored a passing score. Out of 49 candidates for judges of the Appeals Chamber of the HACC, only 19 candidates scored a passing score.

Posternak emphasized that this is a judicial body that was created not so long ago under the supervision of our partners and civil society.

"A well-known saying attributed to the second President of Ukraine Leonid Kuchma: "No matter what party is built, the Comunists Party still comes out." In our case: no matter what court is created, the "Soviet People's Court" still comes out," the expert wrote.

The consequence of degradation, according to Posternak, may be the Polish version, where the new coalition that won last year's elections provided for the liquidation of the Central Anti-Corruption Bureau in the agreement.

"In our realities, it may be about dismantling the entire anti-corruption triangle - NABU-SAPO-HACC, as, at least, ineffective. And in reality - harmful," the expert concluded.
