The Verkhovna Rada supported the bills on international crimes to implement the Rome Statute.
The Verkhovna Rada adopted in the first reading the bills on criminal liability for international crimes to implement the Rome Statute in Ukraine
This was announced by the MP from the Holos faction Yaroslav Zhelezniak in his Telegram channel, Ukrainian News Agency reports.
238 MPs voted for bill No. 11538 as the basis with the minimum required 226, for No. 11539 - 240.
It is proposed to determine the list of crimes that are considered international:
-the crime of genocide and leadership in its commission;
- public calls for the crime of genocide or its justification or denial;
- a crime against humanity in the form of murder and in other forms, a war crime in the form of murder;
- a war crime in the form of a serious violation of the norms of international humanitarian law in connection with an international armed conflict;
- a war crime in the form of a serious violation of the norms of international humanitarian law in connection with an armed conflict of a non-international nature;
- a war crime in the form of a serious violation of the norms of international humanitarian law in connection with an international armed conflict or an armed conflict of a non-international nature; crime of aggression; propaganda of an act of aggression; responsibility of a commander (chief) for international crimes of subordinates).
Ukraine does not recognize any immunities for persons who have committed international crimes stipulated by law.
A system of penalties for international crimes is established, which includes the main penalties exclusively in the form of imprisonment (for a term of up to 30 years) and life imprisonment, as well as an additional penalty in the form of confiscation of property.
No statute of limitations will be applied for international crimes. At the same time, the only and exclusive basis for exemption from serving a sentence for an international crime is a pardon by the President.
In addition, it is proposed to establish the responsibility of the commander (chief) for the international crimes of subordinates.
Failure by a military commander or a person who actually acts as a military commander, who knew or, under the circumstances, should have known, and did nothing to prevent such a crime, stop its commission, or refer this matter to the competent authorities for investigation and criminal prosecution, is punishable by imprisonment for a term of 20 to 30 years.
Separately, liability has been introduced for justifying or denying genocide or distributing materials about it, which will be punishable by imprisonment for a term of up to 20 years.
Imprisonment for 20 years is proposed to punish the distribution or public use of materials calling for aggressive war or the resolution of a military conflict, denying the conduct of aggressive war or justifying it, or praising or glorifying an aggressor state or its representative.
It is proposed that intentional serious violation of the norms of international humanitarian law during international armed conflicts be punishable by imprisonment for a term of up to 20 years.
As Ukrainian News Agency earlier reported, on August 21, the Verkhovna Rada ratified the Rome Statute of the International Criminal Court.
