Jury Trial to appear in Ukraine

The Verkhovna Rada intends to introduce a new institute of Jury Trial.

232 MPs voted for bill No. 3843 as a basis, with the minimum required 226.

This was announced by Yaroslav Zhelezniak, MP from the Holos faction, on his Telegram channel, Ukrainian News Agency reports.

According to the bill, a jury trial is a form of direct implementation of the natural, constitutionally enshrined right of the people to justice, and consists of one professional judge and a jury.

A professional jury trial judge is the procedural presiding judge in the court session and does not participate in the decisions made by the jury on the merits of accusing a person of committing an act.

The jury bench consists of eight jurors, who are formed on the basis of a random automated selection of candidate jurors from among citizens of Ukraine who permanently reside in the relevant judicial district and meet the requirements.

The document, in particular, stipulates that:

- the jury verdict on the guilt of a person is considered accepted if at least 7 out of 8 jurors vote for it;

- being a juror is a civic duty, the age of jurors is from 21 years;

- jurors are provided with guarantees of immunity from judges during the performance of their duties in court (detention and arrest - with the consent of the High Council of Justice);

- the juror will receive remuneration at the level of the official salary of a judge of a local court (in 2024 - UAH 63,000 per month), and travel, housing and daily allowance expenses are also reimbursed.

As Ukrainian News Agency earlier reported, in 2021, President Volodymyr Zelenskyy stated that within the framework of the strategy for the development of justice and constitutional justice for 2021-2023, it is necessary to introduce the institution of jury trial.
