Rada to allow law enforcement agencies through court to temporarily stop work of enterprises

The Verkhovna Rada intends to allow law enforcement agencies through the court to temporarily restrict the activities of legal entities, if there are sufficient grounds to believe that in the interests of the legal entity actions may be taken that hinder criminal proceedings.

268 parliamentarians voted for the adoption of the corresponding bill as a basis, with the minimum required 226, the Ukrainian News agency reports.

The Criminal Procedure Code is supplemented by a new Article 96 (10-1).

It defines additional (non-financial) measures of a criminal legal nature.

Among such measures: temporary restriction of the activity of a legal entity - a prohibition for a legal entity to carry out a certain type and/or types of activity during the time determined by the court decision.

In particular:

1) participate in public and defense procurement;

2) use the license (suspension of the license in whole or in part);

3) participate in the privatization of state and communal property;

4) to participate in the lease of state and communal property (in particular, the prohibition of extending the lease);

5) obtain, extend the term of validity of a special permit for the use of subsoil (in particular, suspension of the validity of a special permit for the use of subsoil);

6) participate in social dialogue bodies;

7) buy domestic government loan bonds;

8) create and participate in the work of self-regulatory organizations;

9) provide and receive advertising of their activities;

10) carry out sponsorship;

11) participate in public-private partnership;

12) participate in the activities of joint enterprises.

It is proposed to establish that if there are sufficient grounds to believe that actions may be taken on behalf of a legal entity and/or in its interests, aimed at avoiding the application of criminal law measures to it, and/or preventing criminal proceedings in another way, the investigator, in agreement with the prosecutor, the prosecutor applies to the investigating judge (court) with a request to apply restrictions to a legal entity, in relation to which measures of a criminal law nature may be applied.

As the Ukrainian News agency earlier reported, the specialized committee of the Rada advocated the return of business inspections from eco-inspections.
