PrivatBank wins over Nikopol Ferroalloy Plant in appeals court

PrivatBank has won over the Nikopol Ferroalloy Plant associated with Ihor Kolomoisky in the appeals court.

This is stated in the bank's message, the Ukrainian News agency reports.

The Northern Commercial Court of Appeal satisfied the appeal of PrivatBank, annulled the decision of the Commercial Court and refused to satisfy the claim of the Nikopol Ferroalloy Plant.

The consideration of this case in the appeal lasted for almost a year, because the Nikopol Ferroalloy Plant and its affiliated companies, in particular the Zaporizhzhia Ferroalloy Plant, the Marhanets and Pokrovsk Mining and Enrichment Plants, tried in every possible way to prolong the proceedings: they filed numerous motions to recuse the panel of judges and complaints about correcting mistakes in previous decisions of other courts.

Enterprises are trying to obtain from the Ukrainian courts a decision to recognize all obligations under the loans as "fulfilled", although the bank had no disputes with them and no claims regarding the return of the loans.

According to the lawyers of PrivatBank, such decisions of the Ukrainian courts were needed by the ex-owners of the bank to try to strengthen their arguments in the American trial of PrivatBank, where the money laundering case is being considered.

As the Ukrainian News agency earlier reported, in 2019 PrivatBank initiated legal proceedings in the state of Delaware (U.S.) against former co-owners Ihor Kolomoiskyi and Hennadii Boholiubov, as well as a number of other individuals and legal entities.

The bank is seeking compensation for damages it suffered as a result of actions taken by the former owners, their close associates, and companies registered in the United States.

The purpose of these schemes was "to acquire assets in the United States in the amount of hundreds of millions of U.S. dollars by appropriating and legalizing funds obtained from corporate loans issued by PrivatBank during the period when it was under the control of its former owners."

The lawsuit for more than USD 685 million plus interest names the ferroalloy companies mentioned above as participants in the bank's costs withdrawal scheme.
