Naftogaz Asking ECJ To Abolish Ruling Of European Commission To Widen Gazprom's Access To OPAL Pipeline

On March 27, the Naftogaz of Ukraine national joint stock company appealed to the European Court of Justice (ECJ) demanding abolition of the decision by the European Commission dated October 28, 2016 that allows the Russian gas monopoly, Gazprom, to expand use of the OPAL gas pipeline facilities and increase the volume of gas pumped via the Nord Stream gas pipeline.

The company has said this in a statement, Ukrainian News Agency reports.

According to the NJSC, respective decision bypassing Ukraine violates Article 274 of the Ukraine-European Union Association Agreement as well as obligations of the EU under the Energy Charter Treaty and the Energy Community foundation agreement.

At present, the said decision of the European Commission is suspended.

As Ukrainian News Agency earlier reported, the OPAL pipeline with the capacity of 36 billion cubic meters of gas connects the Nord Stream pipeline with the Federal Republic of Germany and the Czech Republic.

The pipeline allows Gazprom to enter markets of Central and Eastern Europe bypassing Ukraine.
