The National Anticorruption Bureau of Ukraine (NACB) denies any violations in serving the notice of suspicion to Roman Nasirov after 10 p.m. on March 2.
The press service of NACB wrote this on its Facebook page, Ukrainian News Agency reports.
"Since the serving of a notice of suspicion is a procedural action, rather than an investigative action, the norm prohibiting (this action) in the period from 10 p.m. to 6 a.m. does not apply," reads the statement.
In the wake of the remarks about alleged mistakes of detectives of NACB when serving the notice of suspicion to Nasirov late in the evening the press service notes that Nasirov was conscious and required no urgent medical treatment and a commission of doctors confirmed that later.
The press service of NACB also notes that an article of the Criminal Procedure Code of Ukraine requires that a written notice of suspicion must be served on the date of the document.
Since the document was dated March 2 the detectives served it to Nasirov on March 2.
The press service of NACB notes that detectives of the Bureau and prosecutors of the Specialized Anticorruption Prosecutor's Office acted in compliance with the Criminal Procedure Code of Ukraine.
As Ukrainian News Agency earlier reported, Prosecutor General Yurii Lutsenko said Roman Nasirov should not have been served the notice of suspicion in the evening and detectives of NACB and prosecutors of the Specialized Anticorruption Prosecutor's Office should have served it in the morning of March 3.
Nasirov is suspected of power abuse and inflicting losses of UAH 2 billion on the State.
On March 3, 2017, the Cabinet of Ministers of Ukraine suspended Nasirov as the head of the State Fiscal Service of Ukraine.
