Supreme Court Refuses To Review Decision Finding Wrongful Internal Ministry's Refusal To Provide Ukrainian News Agency With List Of Persons Awarded With Signature Weapons In 2014-2015

The Supreme Court has refused to review the Higher Administrative Court's decision upholding as wrongful the Ministry of Internal Affairs' refusal to provide Ukrainian News Agency information about the list of persons awarded with signature weapons in 2014-2015.

The Supreme Court produced this decision on December 7, 2016.

As Ukrainian News Agency earlier reported, the Higher Administrative Court confirmed that the Internal Ministry's refusal to disclose to Ukrainian News Agency the list of persons awarded with signature weapons in 2014-2015 was unlawful.

In May 2016, the District Administrative Court of Kyiv ruled as unlawful the Internal Ministry's refusal to provide Ukrainian News Agency information about the list of persons awarded with signature weapons in 2014 and 2015.

The Court ordered the Ministry to reconsider the Agency requests with reference to the Court's conclusions.

In the whereases, the tribunal emphasised that a State award-including firearms-is always a public manifestation of commendation of a citizen by the State, so information about the awarded persons in public by nature and access to it cannot be restricted.
