Constitutional Court Finds Unconstitutional Abeyance Of Pension Payment To Ex-Military Employed In Public Sector

The Constitutional Court has found unconstitutional the temporary cancellation for the period of the year 2016 of pensions for former servicemen employed in the public sector.

Chief of the Court Yurii Baulin has announced this, Ukrainian News Agency reports.

The Constitutional Court has decided that provisions contained in the second sentence of part 7 of article 43 and in part 1 of article 54 of the law "On retirement benefits for persons discharged from military service, and some other persons" are contrary to the Fundamental Law.

In keeping with the above provisions, maximum pension cannot exceed 10 minimum subsistence levels for persons who have lost the ability to work.

Moreover, a cap of UAH 10,740 was put on the pensions paid to members of the military January 1 through December 31, 2016.

The Constitutional Court has ruled that these norms unconstitutional and shall lose force from the moment of announcement of this decision.

As Ukrainian News Agency earlier reported, the Constitutional Court in June ruled unconstitutional the UAH 10,740 limit on judges' pensions.
