NACP draws up another corruption protocol against Constitutional Court Acting Chair Holovatyi, now he can be dismissed

The National Agency on Corruption Prevention (NACP) has drawn up another administrative protocol on corruption against the Acting Chairman of the Constitutional Court Serhii Holovatyi, now he can be dismissed from his post.

The NACP informed about this, Ukrainian News Agency reports.

The NACP found that the Acting Chairman of the Constitutional Court Serhii Holovatyi made a decision in the context of a real conflict of interest, which was not reported in the prescribed manner.

Thus, a complaint was submitted to the Constitutional Court, in which the applicant noted that Holovatyi had knowingly entered false information into the court ruling, and insisted on his dismissal.

Not wanting to submit the said appeal for consideration by the special plenary session of the Constitutional Court, from where it could get to the commission on the rules and ethics of the Constitutional Court (on the basis of the conclusion of which Holovatyi could be dismissed), he proposed the said appeal for consideration in the agenda of the ordinary meeting.

The procedure of such a meeting does not provide for the possibility of sending an appeal to the specified commission.

Thus, being empowered as the Acting Head of the Constitutional Court, Holovatyi protected himself from a possible further check of his actions, under the consequences of which he could be dismissed.

The actions of the Acting Head of the Constitutional Court are qualified under Parts 1, 2, Article 172-7 (violation of the requirements for preventing and resolving conflicts of interest) of the Administrative Code.

The compiled protocol is sent to Holovatyi for review.

If the court finds the official guilty, then he faces a fine, and it is also possible that Holovatyi could be put into the Unified State Register of persons who committed corruption or corruption-related offenses.

The actions of the judge can be regarded as the commission of a significant disciplinary offense, in connection with which the judge can be dismissed from office.

As Ukrainian News Agency earlier reported, the Acting Head of the Constitutional Court, found guilty of corruption, in January received UAH 220,000 of salary, and before the New Year another UAH 300,000.

The Holosiivskyi District Court of Kyiv convicted the Acting Head of the Constitutional Court Serhii Holovatyi of an administrative offense and ordered him to pay a fine of UAH 1,700. The court found that the Acting Head of the Constitutional Court did not comply with the legal requirements of the National Agency on Corruption Prevention (NACP), namely, did not eliminate violations of the requirements of Art. 12, Part 8 of the Law of Ukraine On the Prevention of Corruption and did not provide information, as well as copies of documents required in the NACP request from 09/14/2023.
