Court dismisses case against ex-minister Nasalyk
The Appeal Chamber of the High Anti-Corruption Court has closed the case against the former Minister of Energy and Coal Industry Ihor Nasalyk regarding the declaration of false information.
This is stated in the court materials, Ukrainian News Agency reports.
On October 19, the Appeal Chamber of the High Anti-Corruption Court considered the appeals of the applicant's defenders for the HACC decision of July 12, 2023 on leaving without satisfaction an application for the consideration under exceptional circumstances of the HACC decision of April 1, 2021 on closing criminal proceedings on the declaration of false information by the former Minister of Energy and Coal Industry.
Based on the results of the consideration, the panel of judges satisfied the appeals and decided to close the criminal proceedings under the accusation of the former Minister of Energy and Coal Industry of committing a criminal offense under Art. 366-1 of the Criminal Code of Ukraine, due to the absence of a criminal offense in the actions.
The decision has been legally effective since the proclamation, but can be appealed by cassation to the Supreme Court.
As Ukrainian News Agency earlier reported, the Specialized Anti-Corruption Prosecutor's Office and the National Anti-Corruption Bureau accused Nasalyk of non-declaring USD 1.2 million in borrowed funds.
Nasalyk, for whom the court established a psychological examination, said that he was ready to pass a polygraph test (lie detector) in order to prove the groundlessness of his accusation of declaring inaccurate information.
