NBU has not yet decided what to do with Ukrposhta due to its refusal to dismiss Smilianskyi

The National Bank has not yet decided what further measures to take regarding the joint-stock company Ukrposhta, which refuses to dismiss the company's general director Ihor Smilianskyi.

This was reported to the Ukrainian News Agency by the NBU.

It is noted that the National Bank received an official letter from the joint-stock company Ukrposhta, took into account the information about the circumstances that complicate the implementation of the decision regarding the head, and will react in a measured manner within its powers and current procedures.

Thus, the legal grounds for further actions and the distribution of responsibility for fulfilling the established requirements fully apply to all participants in the process - the National Bank as a regulator, JSC Ukrposhta and its officials, as well as the company's shareholder in the person of the Ministry of Development of Communities, Territories and Infrastructure.

The specifics of the activities of legal entities whose sole participant (shareholder) is the state may, in practice, complicate the smooth implementation of the general requirements established for payment market participants.

Regarding JSC Ukrposhta as a provider of financial payment services, no special exceptions are provided - a general approach is applied.

The NBU emphasized that JSC Ukrposhta remains part of the critical infrastructure, therefore decisions regarding the company will be made carefully, taking into account the need to maintain its uninterrupted operation.

On the other hand, the specifics of the legal status of JSC Ukrposhta are not an obstacle to the exercise of the powers of the National Bank if there are appropriate grounds and compliance with the procedures established by current legislation.

This status also does not exempt the company from proper implementation of the established requirements - on the contrary, the importance of Ukrposhta as a participant in the payment infrastructure necessitates the need for an appropriate level of compliance and a responsible attitude to compliance with regulatory requirements.

The National Bank will hold relevant consultations with the government and the Ministry of Community, Territorial and Infrastructure Development and will accordingly choose the optimal response model.

As Ukrainian News Agency earlier reported, on June 23, the NBU announced that it had made a decision on the non-compliance of the director general of JSC Ukrposhta Ihor Smilianskyi with the requirements for professional suitability established for the head of a financial payment services provider.

In view of this decision, in accordance with the requirements of the legislation, JSC Ukrposhta represented by the authorized body must take all necessary actions to replace the director general and bring its activities into line with the requirements of the legislation of Ukraine and the regulatory legal acts of the NBU.

The National Bank demanded that the authorized body of JSC Ukrposhta remove Smilianskyi from management within five working days, and then appoint a new head who meets the requirements for professional suitability within two months.

After that, it became known that the director general of Ukrposhta, Smilianskyi, continues to work in his position.
