Defense Ministry approves criteria for determining defense industry enterprises as critical

The Ministry of Defense has approved the criteria for determining enterprises, institutions and organizations in the defense industry, aircraft industry and space activities as those that are important for the national economy and may be eligible for the booking of up to 100% of personnel liable for military service. This is stated in the message of the Ministry of Defense, the Ukrainian News agency reports.

The Ministry of Defense has started officially accepting documents from companies to determine their status via e-mail admou@post.mil.gov.ua

The above functions were previously performed by the liquidated Ministry of Strategic Industries.

It is noted that the criteria approved by the order of the Ministry of Defense retain the current approach to determining such enterprises.

For enterprises that have already received the status of an enterprise of importance to the national economy and the validity of this status has not expired, no additional actions or changes to documents are required.

Criteria that must be met by enterprises that apply for the status of important for the national economy in the defense industry and, accordingly, may be entitled to book up to 100% of employees liable for military service are as follows:

execution of a state contract (agreement) in the field of defense or participation in its execution on the basis of agreements, including foreign economic ones; the volume of production of defense products should be more than 50% of the total volume of the enterprise for the last reporting period;

receiving state financial support in the form of grants in accordance with Resolution of the Cabinet of Ministers of March 8, 2024 No. 262 "Some Issues of Ensuring the Development of Innovations and Technologies for Defense Needs";

performing the functions of an authorized entity managing state-owned objects, which regulates, controls and coordinates the activities of defense industry enterprises.

Enterprises, institutions and organizations in the defense industry that do not meet the above criteria may be granted the status of important for the national economy if they meet at least three of the following requirements:

execution of state contracts in the field of defense;

involvement in the execution of defense orders under contracts, including foreign economic contracts;

inclusion in the electronic register of selection participants and executors of state contracts;

participation in the implementation of state target programs in the fields of aircraft construction or space activities;

participation in the implementation of programs for the development of the defense-industrial complex, the introduction of new technologies, the expansion of production capacities;

production of goods, performance of work or provision of services used by defense industry enterprises for the manufacture of defense products.

In case of compliance with at least two mandatory criteria of the Resolution of the Cabinet of Ministers of January 27, 2023, No. 76 "Some Issues of Implementation of the Provisions of the Law of Ukraine "On Mobilization Preparation and Mobilization" on the Booking of Persons Liable for Military Service for the Period of Mobilization and for Wartime", such enterprises, institutions, and organizations may be determined to be critical to the functioning of the economy and the livelihoods of the population during a special period, which will allow the booking of up to 50% of employees liable for military service.

As the Ukrainian News agency earlier reported, on October 9, the Verkhovna Rada gave critical defense companies the right to book people who do not have proper military registration documents for 45 days.

On October 31, President Volodymyr Zelenskyy signed this law.
