Rotterdam+ case finally closed: decision on exemption from liability enters into force
On August 26, 2025, the decision of the Supreme Anti-Corruption Court on the non-involvement of the former head of the National Commission for the Regulation of Energy and Utilities of Ukraine Oksana Kryvenko in the Rotterdam+ case came into force. Kryvenko herself reported this on her Facebook page.
By the decision of the High Anti-Corruption Court of August 21, Kryvenko was exempted from any criminal liability. The court established that she did not participate in the introduction of the formula, since she headed the Regulator in 2018, when the methodology was already in effect. In addition, no damage to the state or consumers was proven, and there are no victims in the case.
Thus, by the final court decision, all charges against Kryvenko were dropped.
As a reminder, back in October 2021, the trial confirmed that there was no element of a crime in the case, and there were no grounds to continue the investigation. During 2018–2021, the criminal proceedings were closed and reopened several times, but the conclusion remained unchanged: there was no element of a crime.
