Court explains why it dismissed case on division of Poroshenkos' property
The Kryzhopilskyi court of the Vinnytsia Region explained why it dismissed the proceedings on the lawsuit of Maryna Poroshenko against Petro Poroshenko on the division of the spouses' property.
This is evidenced by the data of the court registry, Ukrainian News Agency reports.
The court found that at the time of filing the lawsuit of Maryna Poroshenko on the division of the spouses' property, there was no subject of dispute. In particular, before filing the lawsuit, as stated in the lawsuit itself, and as recognized by the parties in their statements submitted to the court on April 3, 2025, and in the court session on May 16, 2025, the parties reached an oral agreement on the division of the property specified in the lawsuit in exactly the manner indicated by the plaintiff, and as for the remaining property, they determined its legal status, namely: to leave it in the joint ownership of the parties as spouses.
In view of Part 1 of Article 71 of the Civil Code of Ukraine - if the wife and husband have not agreed on the procedure for dividing property, the dispute may be resolved by the court. In view of the above, the court does not consider that a dispute has arisen between the parties, but considers that there is an agreement between the latter on the division of property. The plaintiff did not provide the court with evidence of the impossibility of voluntarily concluding an agreement on the division of property, which is specified in the lawsuit with the award of the relevant property to each of the spouses, as the parties reached an agreement.
Therefore, the court concludes that both at the time of filing the lawsuit and at the time the case was pending in court, there was and is no dispute between the parties regarding the division of marital property.
