Rada wants to introduce market surveillance for products sold via Internet
The Verkhovna Rada intends to introduce market surveillance for products sold via the Internet.
Iryna Herashchenko, co-chair of the European Solidarity faction, announced this on her Telegram channel, the Ukrainian News agency reports.
She noted that bill No. 12426 was adopted as a basis.
The bill proposes to implement the norms of EU Regulation No. 305/2011 1020 into national legislation on state market surveillance
In particular, it is envisaged to introduce market surveillance for products sold via the Internet or through other methods of distance trading.
At the same time, the procedure for conducting checks on the characteristics of products provided on the market through online trading or through other methods of distance trading is clearly regulated.
It is determined that state market surveillance is the activity of market surveillance bodies to ensure that products comply with the established requirements, as well as to ensure the absence of threats to public interests.
State market surveillance measures are:
1) checking product characteristics, including the selection of product samples and their examination (testing);
2) restrictive (corrective) measures, including:
- restriction of the provision of products on the market;
- prohibition of the provision of products on the market;
- withdrawal of products from circulation;
- product recall;
3) monitoring the implementation of decisions on the adoption of restrictive (corrective) measures;
4) warning consumers (users) by market surveillance bodies about the danger identified by these bodies posed by the product.
The explanatory note states that there is currently a lack of regulation of the issue of product safety sold through online stores or other methods of distance trading, and a lack of effective mechanisms to protect consumers and business entities from unfair competition during online sales.
As the Ukrainian News agency earlier reported, in September 2024, the Cabinet of Ministers resumed the implementation of planned measures of state market supervision and control for a number of goods.
