There are no longer any bans in Ukraine for lustrated ex-officials

The terms of lustration restrictions on holding positions in the civil service and in law enforcement agencies have expired due to the expiration of the 10-year term established by the Law "On Lustration".

This is evidenced by legislation, Ukrainian News Agency reports.

Lustration regulations of the Law "On Purification of Power" (lustration) dated September 16, 2014, which provided for a ban on holding positions in the civil service and in law enforcement agencies for persons who held managerial (administrative) positions for at least one year in the period from 2010 to 2014 years or participated in countering mass protests during the Maidan events, became invalid due to the expiration of the relevant legal provisions.

The Law "On Purification of Power" entered into force on October 16, 2014.

The law provided for lustration restrictions for several categories of officials and representatives of law enforcement agencies, but the largest categories affected by lustration were civil servants, judges, and representatives of law enforcement agencies, who held managerial (administrative) positions in the period from February 25, 2010 to February 22, 2014 for a period of at least 1 year, as well as persons, who held leadership positions or were involved in opposing protests during the Maidan events - from November 21, 2013 to February 22, 2014.

For some categories, the ban was valid for 5 years, and for others - 10 years.

In 2014, the majority of persons, subject to the lustration law, resigned themselves from their positions in order not to be included in the Unified State Register of Persons subject to the provisions of the law, or were dismissed under general circumstances by the new heads of certain state institutions and bodies.

However, as a result of lustration checks in 2014-2016, about 900 persons were in the Register of lustrated persons.

The Law "On Purification of Power" in 2014-2015 caused a lot of criticism and comments, due to which a number of constitutional submissions were sent to the Constitutional Court.

However, in ten years since the submission of these submissions, the Constitutional Court has not been able to consider them.

As Ukrainian News Agency earlier reported, on February 25, 2020, the Grand Chamber of the ECHR rejected Ukraine's appeal against the decision of the ECHR in the case "Poliakh et al. v. Ukraine", thereby confirming the recognition of the law "On Purification of Power" (lustration) in Ukraine as a violation of human rights.
