British national Hugh Jones is asking the Kyiv Court of Appeal to reverse the judgment on his eviction from an apartment in Shevchenkivskyi district of the capital, handed down after demand by chairman of the Malyn District State Administration of Zhytomyr Region Yurii Martyniuk, Ukrainian News Agency has learned form Jones's lawyer Maryna Pavlenchuk.

She underlines that by the decision of Judge of the Shevchenkivskyi District Court of Kyiv Serhii Zubkov (murdered in 2011) a two-level attic floor built over Jones' own flat at 31/16 Reitarska Street was declared property of another person, citizen of Israel Winkler.

But prosecutors opened a criminal proceeding upon Winkler providing the tribunal with forged documents concerning right of use of part of the apartment.

In 2013 the Court ordered the State Enforcement Service to evict Jones and in 2014 it determined that the eviction had to take place by way of dismantling a partition of the wall of his flat in the fourth floor.

The Britishman appealed this award, and the Appeal Court is hearing it on October 2 at 14:05.

The lawyer notes that Yurii Martyniuk (member of the Svoboda All-Ukrainian Association party, incumbent head of the Malyn District State Administration) represents Winkler in the trial, and supposes that he as a public official can use administrative pressure on the court.

As Ukrainian News earlier reported, Judge Zubkov was murdered in March 2011.

In October 2012 father and son Dmytro and Serhii Pavlichenko were sentenced on charges of the Judge's homicide; by the decision of Judge Zubkov they were evicted from a flat in Shevchenkivskyi district of Kyiv.

But in February 2014 the Pavlichenko father and son were released and rehabilitated as political prisoners.
