Constitutional Court To Commence Hearing On Constitutionality Of Law On Deprival Yanukovych Of Rank Of President On October 19

The Constitutional Court of Ukraine will commence hearing on October 19 to assess the constitutionality of the law depriving Viktor Yanukovych of his rank of the President.

The press service of the Constitutional Court announced this in a statement, Ukrainian News Agency reports.

The statement reads that the hearing will begin at 10.00 following a motion from President of Ukraine Petro Poroshenko.

The case will be considered in the form of written hearings.

As Ukrainian News Agency earlier reported, in June 2015 President Petro Poroshenko asked the Constitutional Court to estimate the constitutionality of the law depriving Viktor Yanukovych of his rank of the President.

Poroshenko said that the Parliament violated provisions of Section 3 of Article 105 of the Basic Law that envision that the rank of a President is assign for term of life, except for the cases of impeachment.

On 4 February 2015, the Verkhovna Rada adopted a law depriving Viktor Yanukovych the rank of the President.

The explanatory note says that the early termination of Yanukovych's authority was on grounds not provided for by the Constitution.

Under Article 108 of the Fundamental Law, President's powers can be discontinued ahead of time in the event of: resignation, impossibility to discharge duties for reasons of health; ousting through impeachment; or death.
