Supreme Court did not allow construction of National Memorial Cemetery in Kyiv Region. Military outraged

The command of the Airborne Assault Forces of the Armed Forces of Ukraine criticized the decision of the Supreme Court, which effectively stopped the construction of the National Military Memorial Cemetery in the Kyiv Region. This is stated in the post of the Airborne Assault Forces on Facebook.

According to the military, the state allocated a plot of 258.7 hectares in the Markhalivskyi Forest for the implementation of the project. The memorial was planned as the main military Pantheon of the country.

However, the creation of the cemetery was challenged in court. The lawsuit was filed by the public organization "Markhalivka. Support", which pointed to the violation of the procedure for changing the purpose of the land by the Kyiv Regional Military Administration, as well as the environmental status of the territory, which is part of the so-called "Emerald Network".

On January 29, 2026, the panel of judges of the Supreme Court, chaired by Judge Rybachuk, rejected the cassation appeals of the Kyiv Regional Military Administration and the state institution "National Military Memorial Cemetery". The court confirmed the decisions of previous instances, which declared the seizure of land for the memorial complex unlawful.

Position of the Airborne Assault Forces

"We respect the laws of Ukraine, because it is for a legal and just state that we are fighting. However, we are convinced that justice cannot exist in isolation from morality and national interests... While the Airborne Assault Forces and other units of the Defense Forces of Ukraine hold the front around the clock, for almost four years of a full-scale invasion, in the rear, due to "procedural errors", the right of the fallen soldiers to a dignified, honorable burial is being canceled," the military believe.

The Airborne Assault Forces emphasized that hundreds of mothers, wives, and children are waiting for the creation of the National Memorial.

"Unfortunately, it seems that not all officials and representatives of the judicial branch of government remember that a war is ongoing in Ukraine. Every Ukrainian who today has the opportunity to work in a safe office or live in a peaceful city is in an unpayable debt to those who defend this right at the cost of their own lives. We call for an immediate resolution of the situation so that the memory of the defenders of Ukraine is honored properly, and not buried under piles of court papers," the military added.

We remind you that 6,000 places have been prepared for burials at the National Military Memorial Cemetery.
