US court finds Trump tariffs unconstitutional and blocks their implementation
The US Federal Trade Commission has ruled that President Donald Trump's tariffs are illegal, ruling that the President exceeded his authority.
This is reported by Bloomberg.
On Wednesday, a three-judge panel unanimously ruled that Trump's executive orders imposing massive tariffs on imports violate the US Constitution, as "only Congress has the authority to impose tariffs."
"The global and mirror tariff orders exceed any authority granted to the President ... to regulate imports through tariffs," the court said.
It also noted that the International Emergency Economic Powers Act (IEEPA), which Trump cited, "does not give him such authority."
The court struck down the orders as "unconstitutional." In particular, this applies to 25% tariffs on goods from Canada and Mexico, 20% on Chinese imports and 10% tariffs on goods from all US trading partners, introduced to reduce the trade deficit.
Also canceled are reciprocal tariffs of 20% to 50% on products from 60 countries, which were supposed to take effect on July 9, if agreements with the White House were not reached by then.
Oregon Attorney General Dan Rayfield, who, together with 11 other colleagues, filed a lawsuit against the administration, said: "We brought this case because the Constitution does not give any President unlimited powers to disrupt the economy. This decision confirms that our laws matter and that trade decisions cannot be made at the whim of the President."
The White House criticized the court's decision. A spokesman said: "President Trump has promised to put America first, and the administration is committed to using all the levers of executive power to overcome this crisis and restore American greatness."
Within minutes of the decision being announced, the Trump administration filed an appeal.
Earlier, Trump commented on his tariff policy with the words: "This is a war with the world," and later added: "Not a war at all," explaining that countries "send world leaders to the United States for negotiations," and concluded: "They kissing my a**."
As Ukrainian News Agency earlier reported, on April 2, Donald Trump officially launched a tariff, or "trade" war, against all states, introducing duties on imports depending on the country of origin.
