Ministry of Economy denies reducing maternity leave to 4 months

The Ministry of Economy denies that the new Labor Code provides for the reduction of maternity leave to 4 months. This is stated in the message of the Ministry of Economy, the Ukrainian News agency reports.

Specifically, regarding maternity leave, the Ministry notes that both now and after the adoption of the Labor Code, 126 calendar days of paid leave are provided (70 before and 56 after childbirth).

As for the paternity leave, the Ministry also notes that both now and after the adoption of the Labor Code, a leave of up to 3 years with job preservation is provided, during which the unified social tax (UST) is paid for a woman (in 2026, the UST payment is UAH 1902/month).

"This provision remains unchanged. An employee may be on parental leave until the child reaches the age of three," the ministry emphasizes.

In addition, the ministry explains that the draft of the new Labor Code provides for additional (new) paid paternity leave.

"A new paid parental leave of 4 months is being introduced. Of these, 2 months are provided for the mother, and another 2 months for the father. It is not possible to transfer your part to the other parent. If a child is being raised by a single mother or a single father, he or she can use all 4 months," the statement said.

The Ministry emphasizes that, according to the EU directive, the right to such leave can be used until the child reaches the age of 8.

"This is an additional guarantee that does not replace or reduce the leave of up to 3 years," the ministry emphasizes.

In addition, according to the ministry, the draft Labor Code retains other guarantees for families, in particular:

a ban on the dismissal of workers with children under one and a half years old or a child with a disability;

protection of single mothers and single fathers with a child under 14 years old;

guarantees for pregnant women regarding medical examinations with payment.

As the Ukrainian News agency earlier reported, in January, the Cabinet of Ministers proposed to the Verkhovna Rada to adopt a new draft Labor Code.

The draft Labor Code, among other things, regulates video surveillance at workplaces.
