The Antimonopoly Committee of Ukraine (AMCU) has fined two companies that produce dietary supplements for UAH 11.1 million for false information about their properties.
This is said in a statement by the Antimonopoly Committee, according to the Ukrainian News agency.
"As part of the control over compliance with the legislation on protection against unfair competition by business entities - manufacturers and/or sellers and/or importers of dietary supplements, the Antimonopoly Committee of Ukraine has revealed violations of competition law," the statement said.
Thus, the Committee found that Vorwarts Pharma LLC disseminates information on the packaging and marketplaces about the properties of the dietary supplement Zafacol IQ, in particular, to improve bowel function.
Ersel Pharma Ukraine LLC disseminated information on the properties of the dietary supplement A-KETON, in particular, on the elimination of the causes of high acetone in children.
This information was disseminated on the packaging, on websites owned by Ersel Pharma Ukraine LLC, social media pages, etc.
It is noted that during the consideration of the cases, in confirmation of the properties of dietary supplements, the companies provided, in particular, publications on the properties of individual components of dietary supplements and/or articles on the use of dietary supplements in complex therapy with other drugs.
However, the Ministry of Health of Ukraine expressed the position that such articles are not sufficient grounds to confirm the properties of dietary supplements.
During the consideration of the case, the companies informed the Committee that they would stop disseminating information about the controversial properties of dietary supplements
At the same time, the AMCU found that the companies did not provide proper confirmation of the fact of termination of the dissemination of the disputed information on the packaging of the above dietary supplements and, taking into account all the circumstances, recognized the actions of the companies as violations under Article 15-1 of the Law of Ukraine "On Protection against Unfair Competition", imposed fines and ordered to cease the violation.
As the Ukrainian News agency earlier reported, the Antimonopoly Committee of Ukraine fined 2 companies UAH 19 million for collusion in the purchase of technical salt.
