Rada Enables Sentencing And Confiscation Of Property Of Persons Internationally Wanted For Crimes Against Ukraine In Absentia

Draft law No.4448a received votes of 253 Members of Parliament, while 226 votes enough for approval.

The Verkhovna Rada has enabled sentencing and confiscation of property of persons internationally wanted for crimes against Ukraine in absentia.

Parliament managed to pass the document as a whole only from the fourth try because initially neither adoption of the document nor returning to consideration of this issue gathered 226 votes.

Parliament has made amendments to the Penal Code and the Code of Criminal Procedure.

Thus, it has stipulated that there will be confiscation of property as punishment for actions aimed to forceful change or overthrow the constitutional order; infringement on Ukraine's territorial integrity and inviolability, life of state or public figure; high treason; subversion; espionage; terrorist attack, including calls and inducement of others, creation of terrorist organisations; creation of illegal armed gangs.

It also stipulates that pre-trial restrictions in the form of personal recognisance, guaranty of defendant's appearance with criminal responsibility for nonappearance, home arrest, and bail cannot be applied to persons suspected of the mentioned offences, and court trial can take place in absence of the alleged offender.

Moreover, the document provides for determining that a suspect is a person in regard to whom a notice of suspicion has been drawn up but not handed in because the person has not been located.

As Ukrainian News earlier reported, former President Viktor Yanukovych, former internal affairs minister Vitalii Zakharchenko, and also other top officials were put on the international wanted list.
